This guy sold headlights to my bro & they never turned up, because they weren't up as a item, no comeback :(

He's now selling them again :mad: :mad:

Probably me being a bit dim here but how did your bro buy head lights off this person via ebay if they weren't "up as an item". I presume that to mean advertised on ebay.

Does he mean that classified advert thing they do where there is no feedback or auction? I think thats a free for all and not much to do with ebay other than thats where it advertised.

wow that's harsh. I'd contact ebay & paypal about it as I'm sure he should be able to get his money back as that's basically fraud. Especially if he's used a credit card via paypal as they have built in fraud protection via visa/mastercard.

If your brother paid via Papal he should be able to file a transaction dispute even if the item was an off Ebay transaction.

Recently had a similar problem.

Paid for a service by paypal, this service was advertised on Ebay but the seller invoiced me direct.

Even though Paypal say that only cover physical goods, they still found in my favour & I received a full refund ( I was even daft enough to tell them it was payment for a service & not physical goods ) :confused: :confused:

That said, you'll only get a refund if paypal are able to get the money from the sellers account.

He offered a car for breaking, my bro contacted him for the headlights & paid by paypal, coz the item wasn't listed he had no comeback. The guy said he posted them & its not his fault.

I had the reverse happen to me. I sold an item and it didn't arrive. I was claimed against and lost as the seller has to do everything reasonable to ensure the item is sent without problem which meant that because I hadn't sent it recorded signed for I had not done so. Since then I have always sent items this way

The guy said he posted them & its not his fault.

It might not be his 'fault', but it is his responsibility to ensure an item he sells reaches the buyer.
As Bonzo said, tell your brother to start a dispute through paypal - there's a good chance he'll get his money back. That is as long as he put the payment down as goods and services, and not 'gift'...

As far as I am aware, the Paypal buyer protection scheme is available to all purchases of goods & is not just restricted to Ebay transactions ( Subject to Paypals terms & conditions ) ;)

As the item was for physical goods, if the seller cannot provide a valid tracking number for the parcel ( Paypal will not accept a proof of postage slip ) your brother may very well get his money back ( Subject to the availability of funds in the sellers account )

He may just as well log on to his Paypal account & lodge a transaction dispute, he has nothing to loose but everything to gain ;)

Must admit, in over 800 transactions on Ebay, both as a seller and as a buyer, I have been very lucky & have not had any serious problems.
That said, the few that I have had ( Buying ) have always been sorted by Paypal.
As a seller, I have yet to be scammed but as someone has said, i'll only post by recorded delivery or tracked courier.

Hope your Bro gets his money back, times are too hard to loose your hard earned pay :(

This is a problem. Some of these adds have vehicle spares for sale and if you bid you get a wheel nut or something as stupid. they then have a contact number and thats where it all goes wrong. Its tempting to just tell them what you want and pay for it there and then. Once your dealing outside of the ebay rules you are stuffed, some of these advertisers will do things on a buy it now once you tell them what you want , then your safe.

Well here is the ending.....

He refunded my brothers money after one more email with a dispute threat.

I then won the lights at 10 quid less than my Bro had first paid & picked them up today :D

All's well that ends well
